Is a co-borrower or 'guarantor' on an online loan also liable?

Short answer

It depends entirely on what that person actually signed. A co-maker or surety binds himself solidarily with you, so under Civil Code Art. 2047 the lender may demand the full amount directly from him without first going after you. A true guarantor is only subsidiarily liable and enjoys the benefit of excussion (Civil Code Arts. 2058โ€“2060) โ€” the creditor must first exhaust your assets before turning to him. Crucially, an 'emergency contact' or a name the app scraped from your phone who never signed a guaranty is NOT liable at all โ€” collecting from or harassing them is an unfair practice under SEC MC 18 (2019) and unauthorized processing under RA 10173.

The app listed my sister as 'emergency contact' โ€” is she now my guarantor?

No. An emergency reference or a contact pulled from your phone did not sign a guaranty and owes nothing. A collector who chases or harasses her commits an unfair practice under SEC MC 18 and an unauthorized disclosure under RA 10173 โ€” both are reportable.

I co-signed for a friend โ€” can they collect the whole loan from me?

If you signed as a co-maker or surety, your liability is solidary under Civil Code Art. 2047, so the lender can demand the entire balance from you directly. A true guarantor, by contrast, can invoke the benefit of excussion (Arts. 2058โ€“2060) so the debtor's assets are exhausted first.

Do the interest caps and collection rules still protect a co-borrower?

Yes. A co-maker or guarantor is still owed the SEC MC 3 (2022) caps on the balance and the SEC MC 18 limits on harassment โ€” being liable does not strip away those protections.
