The pawnshop where I pawned my item closed down or disappeared — how do I get it back?

Short answer

A pawnshop cannot simply vanish with your pledge. PD 114 §16 bars it from closing or moving before pledged items' periods expire or the items are sold, and a lawful relocation within the same city or municipality requires published notice — in two local papers, running not less than 3 days and ending 5 days before the move — precisely so pawners can find it. If a branch shut down without releasing or lawfully auctioning your item, your redemption right and the pawnshop's Civil Code duty of care as pledgee survive the closure (Arts. 2099–2100). Because pawnshops are BSP-supervised, file a complaint with the BSP (and, if the operator is a corporation, the SEC), naming the branch, your ticket number, and the item. Keep your ticket — it is your proof of the pledge.

Frequently asked

Can a pawnshop close while holding my item?

Not freely. PD 114 §16 bars closing or moving before pledged items' periods expire or they are sold, and a lawful move needs published notice (two local papers, at least 3 days, ending 5 days before) so pawners can locate the branch.

Does the closure erase my right to my item?

No. Your redemption right and the pawnshop's Civil Code duty of care as pledgee (Arts. 2099–2100) survive the closure. The operator remains answerable for your item or its value.

Who do I complain to?

The BSP, which supervises pawnshops, and the SEC if the operator is a corporation. Name the branch, your ticket number, and the item, and attach your ticket as proof of the pledge.
