I sent a bank transfer to the wrong account — can I recover it?

Short answer

Yes, there is a legal basis to get it back. Money received by mistake creates an obligation to return it under Civil Code Art. 2154 (solutio indebiti), and Art. 2155 covers mistakes of law — the recipient has no right to keep funds you sent in error. Act fast: report the wrong transfer to your bank immediately and ask it to coordinate a recall with the receiving bank. Banks usually cannot simply reverse a completed credit without the recipient's consent, so if the recipient refuses to return it, send a written (ideally notarized) demand, then pursue small claims (for amounts up to ₱1,000,000) or a civil action based on solutio indebiti.

Can my bank just reverse it?

Usually not on its own. Once the money lands in the recipient's account it is theirs on the books, so the bank typically needs the recipient's consent to debit it back. Your bank can still contact the receiving bank to request a recall — report it immediately so the funds are more likely to still be there.

The recipient won't give it back — what can I do?

They have no legal right to keep it. Send a written, ideally notarized, demand citing solutio indebiti (Art. 2154). If they still refuse, file a small claims case for amounts up to ₱1,000,000 (no lawyer needed) or a regular civil action; keeping money known not to be theirs can also expose them to criminal liability.

What proof do I need?

Your transfer receipt or reference number showing the amount, date, and the wrong destination account, your report to the bank, and your demand letter. This establishes the mistaken payment and that you sought return promptly.
