Where should I file my case (venue)?

Short answer
Venue for money and other personal actions is set by Rule 4 of the Rules of Court: you may file where the plaintiff (or any principal plaintiff) resides, or where the defendant (or any principal defendant) resides, at your election as the one suing โ unless a valid, exclusive venue stipulation in your contract says otherwise. For small claims, the case is filed in the Metropolitan/Municipal Trial Court that has territorial jurisdiction under the same residence-based rule. Choosing the venue nearest to you (where allowed) saves travel and cost, so check both your address and the other party's before filing.

An exclusive venue stipulation is generally valid if it is clear and exclusive, but courts have refused to enforce venue clauses in one-sided contracts of adhesion when they unfairly burden the weaker party. If a clause forces you to sue far from home in a lopsided consumer contract, raise it โ the court can still allow the default residence-based venue.
Does venue matter for regulator complaints (BSP, SEC, NPC, DTI)?
Rule 4 venue governs court cases. Administrative complaints to regulators follow each agency's own filing rules, and most now accept online or nationwide filing, so you usually are not tied to a specific court location for those.
What is the difference between venue and jurisdiction?
Jurisdiction is the court's power to hear the type and amount of case (for example, small claims up to PHP1,000,000 in the first-level courts). Venue is merely the geographic place of filing and, in civil cases, can be waived or agreed upon; jurisdiction cannot be conferred by agreement.
