Can I file a complaint if I live in the province?

Short answer

Yes. Regulator complaints are filed online or by email from anywhere in the country โ€” the SEC I-Message Mo portal (imessage.sec.gov.ph), the BSP Online Buddy and consumeraffairs@bsp.gov.ph, the NPC portal at privacy.gov.ph, and DTI's online form all accept filings without you traveling to Manila. For a small claims case, you file at the first-level court where you reside, where the defendant resides, or where the defendant does business โ€” so you can usually file in your own province rather than where the company's head office is.

Frequently asked

Do I have to go to Manila to file?

No. The SEC, BSP, NPC, and DTI all accept complaints through online portals, email, and chatbots, so a consumer anywhere in the country can file without traveling. Keep digital copies of everything you submit.

Where do I file a small claims case if the company is in another city?

You may file in the first-level court where you reside, where the defendant resides, or where the defendant does business, at your option under A.M. No. 08-8-7-SC. That usually lets you file in your own locality.

Can I attend a small claims hearing remotely?

Some courts allow videoconference hearings under Supreme Court issuances, but this depends on the individual court. Ask the Clerk of Court of the branch handling your case whether a remote appearance is available.
