If a pawnshop auctions my jewelry for more than I owe, do I get the extra (surplus)?

Short answer
It depends on your pawn ticket and the pawnshop rules that govern โ do not assume the extra is automatically yours. A pawnshop can dispose of an unredeemed item only at a public auction (Presidential Decree No. 114, ยง15), and that sale extinguishes your loan. Under the general Civil Code rule for a pledge (Article 2115), a debtor is not entitled to the excess of the sale price over the amount owed unless it is otherwise agreed โ and in the same provision the pawnshop cannot run after you for any shortfall. Because pawnshops are governed first by their own special laws and BSP regulations (Civil Code Article 2123), whether you receive a surplus turns on the terms printed on your pawn ticket and the BSP pawnshop rules; check that ticket, and if a surplus is withheld demand it in writing and escalate to the BSP Consumer Assistance Mechanism.

Does PD 114 itself say I get the surplus?
No. PD 114 requires unredeemed items to be sold at public auction (ยงยง14โ15) but contains no clause on money left over after the sale. Any surplus right comes from your pawn agreement, the BSP pawnshop regulations, and โ subsidiarily โ the Civil Code (Art. 2123 says pawnshops follow their special laws and regulations first, the Civil Code only to fill gaps).
What is the Civil Code default rule?
Article 2115 says the auction sale extinguishes the whole obligation: if the price is more than what you owe, the debtor is not entitled to the excess unless otherwise agreed; if it is less, the creditor cannot recover the deficiency despite any stipulation to the contrary. So the 'no surplus unless agreed' default is paired with a 'no deficiency, ever' protection in your favour.
How do I try to claim a surplus?
Ask the pawnshop in writing for the auction proceeds, the loan, the interest and the charges, and demand any excess your pawn ticket or their rules provide. If they refuse, file with the BSP Consumer Assistance Mechanism (BSP supervises pawnshops); for amounts up to โฑ1,000,000 you may also sue in small claims court without a lawyer.
