My pawned item was stolen or lost in a robbery at the pawnshop โ€” can they just refuse to pay?

Short answer

A robbery does not automatically excuse the pawnshop. As pledgee it must keep your item with the diligence of a good father of a family and answers for its loss (Civil Code Art. 2099), and it is responsible for its employees' acts regarding the item (Art. 2100). The Supreme Court held in Sicam v. Jorge (G.R. No. 159617, 2007) that robbery is not per se a fortuitous event: to escape liability under Art. 1174 the pawnshop must prove the loss was truly unforeseeable and that it was free of any negligence. A bare 'we got robbed' is not enough โ€” a branch that failed to keep reasonable security cannot hide behind the hold-up.
