If I voluntarily surrender my vehicle, do I still owe the balance?

Short answer

Surrendering the vehicle does not by itself erase your debt โ€” what matters is what the lender does next and what you get in writing. If, after the surrender, the financier forecloses and sells the vehicle (the foreclosure remedy for an installment sale), the Recto Law (Civil Code Art. 1484) bars any deficiency โ€” it cannot then chase you for the shortfall, and a contrary clause is void. But if you simply hand the vehicle over with no clear agreement, the lender may treat it only as a partial payment, or hold it without selling, and keep billing you. Protect yourself: get a written 'full and final settlement' or dacion en pago / quitclaim stating that the surrender extinguishes the obligation, or at least a signed receipt โ€” and do not sign a surrender form that admits you still owe a balance. Know exactly what you are agreeing to before you release the unit.

Does handing back the vehicle automatically cancel my debt?

No. Surrender is not automatically a settlement. The debt is extinguished cleanly only if the surrender is documented as a full-and-final settlement / dacion en pago, or if the lender forecloses and sells, which bars a deficiency under Art. 1484.

What should the surrender document say?

Ideally that the vehicle is accepted in full and final settlement of the obligation, releasing you (and any co-maker) from further liability. If they won't agree to that, at least get a dated receipt describing the unit's condition โ€” and never sign an acknowledgment of a continuing balance.

They took it and are still billing me.

Ask in writing which remedy they exercised. If they foreclosed and sold it, cite Art. 1484 to stop the deficiency; if they are holding it, demand they either return it or sell and close the account. Escalate to the SEC under RA 11765 if collection continues.
