How many missed payments before my vehicle can be repossessed?

Short answer

There is no fixed statutory number of missed payments that triggers repossession โ€” the default threshold is set by your loan contract, so read what it says about when you are considered in default. Two legal markers do apply, though. Under the Recto Law (Civil Code Art. 1484), the seller can cancel the sale or foreclose the chattel mortgage only when your failure to pay covers two or more installments. And under the Chattel Mortgage Law (Act No. 1508, Sec. 14), the mortgagee may sell the vehicle at public auction only after 30 days from the default ('condition broken'), with at least 10 days' posted notice. Even then, seizure requires your voluntary surrender or a court writ โ€” not force.

My contract says one missed payment is default. Is that valid?

A contract can define default, but the seller's cancel or foreclose remedies under Art. 1484 still require the unpaid amount to cover two or more installments, and any foreclosure sale still follows the Act 1508 timeline.

Can they repossess the day after I miss a payment?

They cannot lawfully seize it by force at any time, and a foreclosure sale cannot happen until 30 days after default with 10 days' notice. Being briefly late is not a licence for a street grab.

I'm behind but paying. What protects me?

Document your payments and communications, and demand lawful process. If collectors threaten or try to grab the vehicle, file under RA 11765 / SEC MC 18.
