Can I get my vehicle back after it was repossessed?

Short answer

It depends on how it was taken and whether it has been sold. Before a foreclosure auction, you can generally reinstate or settle the account under your contract to recover the vehicle, and you may redeem it by paying what is due plus lawful costs before the sale is completed. If it was taken unlawfully โ€” by force or without a sheriff-enforced writ of replevin โ€” the taking itself is contestable: you can demand its return, file a police blotter for the unlawful taking or grave coercion (Revised Penal Code Art. 286), and pursue recovery, since there is no self-help repossession in the Philippines. Once the vehicle is validly foreclosed and sold at public auction under Act No. 1508, recovering the unit is much harder, but the Recto Law still bars any deficiency claim against you.
