Can I record a debt collector's harassing calls as evidence?

Short answer
Be careful โ secretly recording a phone call is risky in the Philippines. Under RA 4200 (Anti-Wiretapping Act, 1965) the country requires the consent of all parties to a private communication before it may be recorded, and a recording made without that consent is a crime AND is inadmissible as evidence (Section 4) โ even if you are one of the people on the call. Safer evidence that is fully lawful: screenshots of SMS, chat, and email; your phone's call log showing the numbers, dates, and times; written notes made right after each call; and statements from anyone the collector contacted. If you want an audio recording, tell the collector you are recording and get their consent on the line first.
This is a genuine trap: many borrowers assume that because they are a party to the call they may record it. Philippine jurisprudence on RA 4200 has not adopted that 'one-party consent' rule, so rely on the written trail (screenshots + call logs) rather than a covert audio recording. But I'm the one being called โ doesn't that make it legal to record?
Not reliably. RA 4200 is applied as an all-party-consent rule, so even a participant who records secretly can be liable, and the recording cannot be used in a hearing (Sec. 4). Use screenshots and call logs, which carry no such risk.
What evidence should I collect instead?
Screenshot every SMS, Messenger, and email; export or photograph your call log showing repeated calls and their timestamps; keep written notes of what was said; and gather statements from any third party the collector contacted. Timestamps that fall before 6 a.m. or after 10 p.m. directly prove a SEC MC 18 violation.
Can I ever use a recording?
If you announce at the start that you are recording and the collector continues, consent is arguably present. When in doubt, rely on the written record, which is unquestionably admissible.
