Can GMS remotely disable my vehicle?

Short answer
Global Mobility Service Philippines' MCCS GPS device is capable of remotely limiting a financed vehicle's ignition/start — that is the device's advertised function, and it is why GMS is able to finance vehicles for drivers who might not qualify for a conventional auto loan. Having that technical capability is not the same as having a legal right to use it: no Philippine statute authorizes remote engine-disable as a way to collect on a loan or repossess a vehicle already in the borrower's possession. A financier that wants to recover or restrict use of a financed vehicle must go through the courts — a replevin action under Rule 60 of the Rules of Court, or foreclosure of the chattel mortgage through a public officer under Act No. 1508 — not a remote switch. Is the device itself illegal to install?
Installing a GPS/kill-switch device is not itself a named crime. What draws a complaint is how it is used — remotely immobilising the vehicle to pressure payment, without a court order, is where GMS's conduct becomes complainable under RA 11765 and SEC MC 18.
Did I agree to this by signing my loan contract?
A contract clause cannot manufacture a right the law withholds. Any stipulation letting the financier evade the Recto Law's limits (Civil Code Art. 1484) is void, and recovering or restricting the vehicle still requires a court process.
My vehicle was just shut off — what do I do first?
Photograph the immobilised vehicle with a timestamp, save the lender's messages, send a written demand to restore its use, and file with the SEC (RA 11765 / SEC MC 18) and the NPC (RA 10173). LabanPH generates those letters for free.
