Short answer

RA 11861 (Expanded Solo Parents Welfare Act of 2022) broadened the definition. A solo parent includes, among others: a parent left to raise a child alone due to the spouse's death, detention, physical or mental incapacity, legal separation, annulment, or abandonment; a woman who gives birth as a consequence of rape (even without a conviction); an unmarried mother or father who keeps and raises the child; a legal guardian, adoptive, or foster parent solely caring for a child; a pregnant woman providing sole parental care to her unborn child; and certain relatives or the spouse/guardian of an overseas Filipino worker who solely cares for the children. You establish your status when you apply for the Solo Parent ID.

Does an unmarried mother or father count as a solo parent?

Yes. RA 11861 Section 4 includes an unmarried mother or father who keeps and raises the child. It also covers a pregnant woman who provides sole parental care and support to her unborn child.

What if my spouse is an OFW โ€” am I a solo parent?

The law can cover the spouse or guardian of a low- or semi-skilled OFW who is away for an extended period (generally 12 months or more) and who solely cares for the children โ€” subject to the conditions in RA 11861. Confirm your specific situation with your local social welfare office.

Do I need a court decision to be recognized?

Not necessarily. Categories such as abandonment, death of a spouse, or being an unmarried parent are established through documents at the social welfare office when you apply for the Solo Parent ID โ€” not always through a court case.
