Solutio indebiti is a rule in the Civil Code (Article 2154): if someone receives something they had no right to demand, and it was delivered to them by mistake, an obligation to return it arises. It applies squarely to a mistaken or erroneous charge โ€” an overpayment, a duplicate, a wrong amount, or a fee billed in error โ€” because the business is holding money it has no legal right to keep. You can demand its return on that basis, and for card or bank charges you also have RA 10870 ยง18 and RA 11765 to force a fix.

Does it matter that the charge was an honest mistake?

No โ€” solutio indebiti is precisely about mistake. Article 2154 requires return when the thing was delivered through mistake and there was no right to demand it. Good faith of the payer does not let the recipient keep money that was never owed.

What if I paid an amount I did owe, but twice?

The second, duplicate payment is undue and recoverable under Article 2154 โ€” you owed the amount once, not twice. Keep both receipts to show the duplication when you demand the refund or file the card dispute.

How do I actually recover the money?

Send a written demand citing Article 2154. For a card/bank charge, also file the RA 10870 ยง18 dispute and, if refused, escalate to the BSP under RA 11765. For any amount up to โ‚ฑ1,000,000 you can file small claims without a lawyer.
