How much notice do I have to give when I resign?

Short answer
For a voluntary resignation without a specific cause, Article 300 of the Labor Code (formerly Article 285) requires you to serve a written notice on your employer at least one (1) month (30 days) in advance. The employer may agree to a shorter period or waive it. You may also resign immediately, without the 30-day notice, for a just cause โ for example, serious insult by the employer, inhuman or unbearable treatment, commission of a crime against you or your family, or other analogous causes.

Can I leave before the 30 days are up?
Only if the employer agrees, or if you have a just cause for immediate resignation under Article 300 (for example, inhuman treatment or a crime committed against you). Leaving early without either can expose you to liability for damages the employer actually suffers from the lack of notice.
Can my employer refuse to accept my resignation?
Resignation is your right; the employer's acceptance is not required for it to take effect after proper notice. What the employer can do is hold you to the 30-day notice (or a shorter agreed period).
Do I still get my final pay if I resign?
Yes. Resignation does not forfeit what you have already earned โ your final pay (unpaid salary, pro-rated 13th-month pay, unused leave conversions) is still due, released within 30 days of separation under Labor Advisory 06-20.
