The GPS kill-switch device malfunctioned and stranded me — is the lender liable?

Short answer

Potentially yes. If a device the lender installed and controls malfunctions — cutting your engine when you are not in default, or immobilising you in an unsafe place — the lender can be civilly liable for the resulting damage. The Civil Code makes those who are negligent in performing their obligations liable for damages (Art. 1170), holds anyone who causes damage through fault or negligence liable for a quasi-delict (Art. 2176), and requires everyone to act with justice and good faith, with liability for wilful or negligent acts contrary to law or morals (Arts. 19–21). Document the incident: time, location, the immobilised unit, and your losses — lost fares, towing, missed work, any danger. Where the financier is SEC-registered, as GMS Philippines is, a wrongful shut-off is also complainable under RA 11765 as an abusive practice.

What losses can I claim?

Provable damage flowing from the malfunction — towing, repairs, lost income for the days you could not drive, and moral damages if the stranding caused serious anxiety or danger. Keep receipts and a written record.

The contract says the lender isn't liable for device faults — does that hold?

A blanket waiver of liability for the lender's own negligence is not automatically valid; courts can strike unconscionable stipulations, and RA 11765 bars terms that unfairly shift risk onto the consumer. Do not assume the clause defeats your claim.

How do I pursue it?

Send a written demand for compensation, and for a pure money claim of ₱1,000,000 or below you can file small claims without a lawyer. For an SEC-registered financier, also file with the SEC under RA 11765. LabanPH builds both.
